ALIVENETA S.r.l. based in Via San Gabriele 31 in Isola della Scala (VERONA) is the owner of the site www.aliveneta.it

1. ACCEPTANCE OF GENERAL CONDITIONS OF SALE

A - By Customer, hereinafter referred to as C., means a private consumer (ie a physical person who buys goods for purposes not related to his professional activity). Once the online purchase procedure has been completed, C. will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of art. 50 and following of Legislative Decree 206/05.

B - Any right of the C. to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property, caused by non-acceptance, even partial, of an order and incorrect use of the goods purchased.

C- The contract stipulated between ALIVENETA S.r.l. and C. must be considered concluded with the acceptance, even if only partial, of the order by ALIVENETA S.r.l .. This acceptance is considered tacit, if not otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the terms and conditions of payment described below.

D-ALIVENETA S.r.l., pursuant to the Decree of the President of the Republic n. 696/1996 does not issue receipt and receipt, if the C. want the invoice is required to communicate it at the time of purchase. A tax invoice will be sent in electronic format.

2. TECHNICAL INFORMATION.

3. AVAILABILITY OF PRODUCTS.

A - ALIVENETA S.r.l. does not guarantee the availability and therefore the immediate shipment of all the products present in our sites, given that access and the possibility of forwarding on-line orders for several pieces, telephone orders or faxes modify in real time the availability of products, in addition to supplying companies, may interrupt supplies without prior notice, or delays may occur during import operations.

B - For goods with urgent delivery dates, please inform us by phone or by mail of the real availability of the product at our office. The goods on our site are normally indicated with AVAILABLE, which means that the item is available, but there is no real certainty that it is ready to ship. To be sure you can ask, the order will normally be processed in 15 or 20 days at most. Sometimes the international warehouses or the producers, the stocks end, our products will remain AVAILABLE and delivered as soon as possible. AVAILABLE does not mean ready shipment from our warehouse, you can inform us for special needs and certainty of prompt delivery both by email and phone.

4. PURCHASE METHODS

A - C. can only purchase products, including VAT, in the electronic catalog of our site exclusively via online, by e-mail or by fax. The customer who sends the order via the Internet will receive, at the end of the procedure, a communication of automatic confirmation from the order placed by e-mail, this confirmation message will contain Date and Time of execution of the order and an "Order Number", from use in any further communication with ALIVENETA Srl. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, using the email info@aliveneta.it.

Assuming that, after sending the order, it does not arrive (after a few minutes) the confirmation of the order by e-mail, the proposal will be understood as not accepted, for all legal purposes, in the case in if you think it is appropriate, you can repeat the order. The order is also accepted and processed within a maximum of 25 days. In case of unexpected supply suspension by producers or sudden unavailability on the market, or for other reasons not dependent on ALIVENETA S.r.l., the order is to be considered canceled.

B - The C. will be subsequently contacted personally by e-mail or telephone to be notified of the real waiting time and delivery.

C - The image accompanying the description of a product may not be fully representative of its characteristics but differ in color or color from the original, dimensions, accessory products in the picture. All the technical information contained in the product data sheets are to be understood as simple general informative material, they can be subject to change without notice from the producers and suppliers.

5. PAYMENT METHODS

A - Cash on delivery: in the case of cash on delivery, an additional fee will be applied to the total amount, clearly shown when the payment method is chosen. The payment, to be made directly to the courier, will take place at the time of delivery of the products. It is possible to pay only in cash, it is not possible to pay by check.

B - Advance bank transfer: the method of payment by bank transfer anticipates that the order will be processed only after the payment by the customer and receipt by ALIVENETA S.r.l. bank transfer. The data to perform the transfer are communicated in the order confirmation e-mail sent to the customer. The purpose of the bank transfer must include the order number and the name and surname of the holder of the order.

C - Postepay Card Reload: just go to any post office or tobacconist and authorized stores, with the card details that will be provided at the time of purchase, and with only the cost of the recharge you can make the payment immediately even without being holders of the Poste Pay card. If, on the other hand, you hold a Poste Pay card, you can conveniently recharge online. The method of payment by postepay recharge requires that the goods are shipped only after payment by the customer and receipt of the same by ALIVENETA S.r.l. The data to perform the postepay recharge are communicated to the Customer by email or whatsapp once the availability of the ordered goods has been ascertained.
6. DELIVERY METHOD

A - ALIVENETA S.r.l. accept orders with delivery in Italy and abroad, however, for particular locations such as San Marino, Vatican City, Livigno and Campione d'Italia, and places with disadvantaged cap, it is right to call for agreements.

B - For every order placed on our sites, ALIVENETA S.r.l. it does not issue a document and it is the customer's responsibility to print and keep the sales note directly from their account. In order to issue an invoice, it is necessary to request it at the moment of order and confirm the information provided by C. when ordering. After the shipment of the goods it will not be possible to issue an invoice.

D - No responsibility can be attributed to ALIVENETA S.r.l. in case of delay in the order or delivery of the order.

E - The delivery of goods is understood to be on the street level unless otherwise communicated.

F - At the time of delivery of the goods by the courier, the C. is required to check that the number of packages delivered corresponds to what is indicated in the accompanying invoice and that the packaging is intact, not damaged, wet or otherwise altered , also in the closing materials (adhesive tape). Any damage to the packaging and / or the product or the mismatch in the number of packages or indications must be immediately contested, affixing RESERVE OF WRITTEN CONTROL (SPECIFYING THE REASON OF THE RESERVE, eg "laundry packaging", "crushed packaging" , etc.) on the courier delivery test. Once the courier's document has been signed, the Customer can not make any objection regarding the external characteristics of the goods delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, according to the procedures provided in this document.

7. RIGHT OF WITHDRAWAL.

A - Pursuant to articles 64 and following of Legislative Decree 206/05, the customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. This right is not possible for the goods ordered specifically, which were not already stocked in our warehouse. Eg. Neuform helicopters and ballistic parachutes.

B - To exercise this right, the customer, within 15 working days from the date of receipt of the goods, must contact ALIVENETA S.r.l. The customer will not pay anything for the return of the product, with the exception of shipping costs related to the return of the goods. ALIVENETA S.r.l. it will also proceed, within the shortest possible time from the return of the goods, to the re-crediting of the amount after having verified the integrity of the goods and withholding only the amount of the shipping costs. The re-credit will take place through the same means of payment used by C. at the time of order.

C - The right of withdrawal is however subject to the following conditions:

- the right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal on part or accessory of it;

- the right of withdrawal does not apply to personalized products.

- the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend placing it in a second box, on which to affix our address;

- the shipment, until delivery at our headquarters, is under the full responsibility of the C .;

- in case of damage to the goods during transport, ALIVENETA S.r.l. will inform the customer of the event, to allow him to promptly report to the courier chosen by him and obtain a refund of the value of the asset (if insured); in this case, the product will be made available to the customer for his return, simultaneously canceling the request for withdrawal;

- ALIVENETA S.r.l. not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;

- upon arrival at our premises, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged, ALIVENETA S.r.l. will deduct 10% of the value from the refund as a contribution to the restoration costs.

D - The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its content), in cases where ALIVENETA S.r.l. finds:

- the non-diligent use of the good that has compromised its integrity, or the use of any consumables;

- the lack of the packaging or its strong damage;

- the absence of integral elements of the product such as accessories or manuals;

- damage to the product due to causes other than transport.

In case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of ALIVENETA S.r.l., available to the C ..

9. PRIVACY

A - The personal data requested when placing the order are collected and processed in order to meet the express requests of C .. ALIVENETA S.r.l. guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in the GDPR and invites you to take a full view in this section: Privacy.

The data controller is ALIVENETA S.r.l., any complaint must be addressed to ALIVENETA S.r.l.

B - The sales contract between C. and ALIVENETA S.r.l. it is concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this contract of distance selling, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Verona.
